In years of dealing with many immigration lawyers I learned that, while this seems quite a specific question, it isn't: the guy who's going to successfully fight deportation for you (i.e.!), is not the same guy speed-tracking your Corporate endorsed H1-B or permanent residency application.
Or recommending how to best file your fiancee Visa, while still divorcing in Italy... (again i.e.!!)

Also, often it's a question of priorities: what's desired? Speedy service? In person meetings? Cost efficiency? A flexible approach?

Thus, to recommend best a little insight (privately or publicly) on the specific matter at hand is helpful.
Giorgio, you're right, good point. It's a green card related issue. Somebody in the process of obtaining a green card and needing clear information on whether they can leave the US, for how long, etc.
James Mayock, besides being a BAIA member and having supported past BAIA events, is surely more than qualified for that kind of consulting.

You may find an answer to a question like that even on his Firm website; otherwise I would call him to guarantee a quick reply.

Massimo: I just noticed this discussion and want to chime in with brief response. If the friend has reached the stage in the Green Card process where AOS Adjustment of Status form I-485 has been filed and AP Advance Parole issued, that document is good in one-year increments for international travel. The isssue of how long one can be gone from the US using this document is unclear to CBP Customs and Border Patrol inspectors. We know that they admonish travelers who have been out for what they consider to be "too long." Some have stated that 30 days is the limit. However, I am not aware of any legal limitation on time out of the US using AP, other than the expiration date of the document. Given that there is a risk of hassle upon return after lengthy absence, its a good idea to return with as much frequency as possible. Warm regards, Jim Mayock jmayock@emvisa.com
